Fototo Terms of Service

1. Terms

1.1 These Terms of Service (“Terms”) govern your use of the Fototo website, mobile applications, and services (collectively, “Fototo”).

1.2 By creating an account or using Fototo, you agree to these Terms. If you do not agree, you must stop using Fototo immediately and delete your account.

2. Accounts and Services

2.1 You must create an account to access most Fototo features, including image, video, and audio generation services.

2.2 You must be at least 18 years old and legally capable of entering into a binding agreement.

2.3 You are responsible for maintaining the confidentiality of your account and all activity under it. Accounts may not be shared or transferred.

2.4 Fototo reserves the right to suspend or terminate accounts that violate these Terms.

2.5 Fototo aims to provide reliable services but does not guarantee uninterrupted availability. Integration with third-party platforms or models may be subject to separate terms and limitations.

3. Purchases, Credits, and Subscriptions

3.1 Paid subscriptions or purchases provide Fototo credits (“Credits”) which can be used for generating creative content such as images, videos, or audio.

3.2 Credits are virtual items only and cannot be exchanged for cash or transferred to other users.

3.3 Credits that remain unused at the end of a billing period will carry forward to the next period, provided your subscription remains active.

3.4 If your subscription ends, you may lose access to unused paid credits. Fototo is not required to reinstate expired or forfeited credits.

3.5 All purchases are final and non-refundable. Taxes may apply depending on your location. For detailed refund information, please see our Refund Policy.

3.6 Failure to pay renewal fees may result in suspension of premium features and forfeiture of credits.

4. Generated Content

4.1 Fototo makes no ownership claim over AI-generated outputs. You may use your generated content for personal or commercial purposes, subject to applicable laws.

4.2 Model outputs may be unpredictable and may not always match prompts or expectations.

4.3 You must not use Fototo to generate illegal, abusive, or harmful content in your jurisdiction.

4.4 Generated content is not a substitute for professional advice (legal, medical, financial, etc.).

5. Data and Privacy

5.1 Fototo stores basic account details and user creations to provide the service.

5.2 Subscribers’ creations are retained as long as their subscription is active. Non-subscribers’ creations may be stored temporarily and deleted automatically after a limited period.

5.3 Deleted images, videos, accounts, and related assets are final and cannot be recovered.

5.4 Fototo prioritizes privacy and uses industry-standard measures to safeguard your data.

6. Restrictions

6.1 You agree not to:

• Reverse engineer, tamper with, or misuse Fototo software or systems.
• Access Fototo through automated scripts, bots, or scraping tools.
• Upload or generate content that is unlawful, offensive, defamatory, harassing, or infringing on intellectual property rights.
• Attempt to disrupt Fototo’s services or compromise other users’ accounts.

6.2 Fototo may remove content or restrict access if these rules are violated.

7. Liability

Fototo is provided “as is” and “as available.” We disclaim all warranties, including fitness for a particular purpose, uninterrupted availability, or error-free operation.

Fototo shall not be liable for damages arising from your use or inability to use the service, including lost profits, lost data, or indirect damages, even if advised of the possibility.

8. Changes to Terms

Fototo may update or revise these Terms at any time. Significant changes will be communicated through the website or email. Continued use of Fototo constitutes acceptance of updated Terms.
